Former SIUC student files suit against her old school

CARBONDALE - A St. Clair County woman, denied readmission to the Southern Illinois University School of Law last summer because she did not attain a high enough grade point average, is suing the university.

Lisa Dawn Rittenhouse, who is represented by Carbondale attorney Darrell Dunham, argues in her petition filed Nov. 18 in a federal court at Benton, that she was the victim of reverse discrimination and denied opportunity within parameters of the Americans with Disabilities Act to continue her pursuit of a law degree at SIUC.

She is requesting more than $1.5 million damages and is demanding a jury trial.

"The university declines to comment on the case and we'll see what happens in court," said SIUC spokesman Rod Sievers.

SIU's board of trustees, the law school and its dean, Peter C. Alexander, are named as defendants in the suit.

Rittenhouse, who was diagnosed and treated for Attention Span Deficit Disorder (ADHD) with hyperactivity and dyslexia since she was 5 and with Type II bipolar disorder since she was 13, had attained a combined grade point average of 1.948 after two semesters. According to law school rules, only students who have attained at least a 1.95 grade point average are given the opportunity to continue, according to the suit.

During the course of filing petitions for readmission, Rittenhouse was one of six students applying for readmission. She was the only one handicapped and had the highest grade point average among the six. She is white. Four students were racial minorities, of whom two did not have a sufficient grade point average to allow them to petition for readmission, according to the suit.

Of the six who applied for readmission, only Rittenhouse was denied, according to the suit.

The petition contains memorandum and letters from Rittenhouse and Alexander during the course of her readmission procedure.

" You people who post on here who can't see the forest for the trees are mind boggling. The point is that she is right. It seems like an easy case of reverse discrimination. And if she is right, I think she should sue. The only way to stop these kinds of things from happening is through the courts. It is unfortunate, but that is the most effective way, it seems. People are tired of this kind of stuff. I am sure there could be some things that we do not know that could have affected SIU's decision, but she does apppear to have a case that SIU was biased against her for perhaps no other reason than her disability or race. " Let's see-Attorneys usually are poor at math and this situation does show an ignorance of basic statistics on the part of Law School Dean Peter Alexander. However, a GPA of 1.948 is ridiculoulsy low, and based on that the former student should not be able to return to law school at SIUC. "

A GPA under 2.0 at a third-tier law school means you will never get hired by anyone. Cut your losses and get out. "

" I am just now hearing about this story but if what I am reading is true sounds like SIU is going to be shelling out 1.5 million. The money should come from the unused salaries of all of the officials involved in this latest SIU fiasco as they would no longer be there if I had anything to do with it. I am ashamed to say that I once attended SIU. "

" People really will sue for anything. If she is only able to maintain a 1.9 GPA, does she really think she would be able to meet the demands of the IL Bar? What a waste of taxpayers' money to fund first a lawsuit, and possibly the education of this woman just for her to fail the IL Bar exam. I guess she needs the 1.5 million in lieu of the salary she thinks she will earn as an attorney. If she really had altruistic goals (i.e. the pursuit of justice) she would only have sought readmission, not all the money. What a joke! "

If you aren't smart enough to make it through a third tier law school, you probably have no business being a lawyer. IF she really is handicapped, the university would have known this and weighed it in their decision. ADHD and severe depression are societies scapegoats because they are rather subjective in nature. There is no clear cut proof that the girl has either problem. A 1.9 GPA is a high D average, who wants a lawyer who couldn't even make C's in law school? Additionally, how exactly did she access private records of 5 other students? This smells of shenanigans. "

" I hope this is not true. If 5 of the 6 were granted readmission and some of them did not have the 1.95 or more then SIU is guilty of gross racism. Surely someone did not wink and say we need a quota. Of course, that is what affirmative action is at it's very core. The favoring, by a government agency, of one race over another for special benefit or treatment. It's 2007 I would think it is time to treat everyone the same.
